When both spouses in New York agree on all terms, such as support, custody, and property division, the divorce is considered uncontested. To file, fill out and submit the Summons with Notice or Summons and Complaint, the Plaintiff's Affidavit, and the Settlement Agreement specifying the conditions of the divorce. Following filing, a judge will assess the case and grant the divorce if all the requirements are met. In uncontested matters, there is no requirement for a trial.
